Inappropriate Denial of FMLA Time

People are being denied for FMLA time when they were trying to get time off to care for a dependent and their time off was not greater than 3 consecutive days in the Verizon Core Company.

Example: My husband is home or my child is home ill for a week. I try to get Wednesday and Thursday off to care for them. I send in a Certification form for them indicating their illness was for the week's time and it is marked off "acute". Because my supervisor only is reporting my time off as Wednesday and Thursday, the member was denied FMLA time because CORE told them it didn't meet the "acute" requirement of greater than 3 calendar days.

This is WRONG. The law states that the incapacity of the patient must be greater than 3 calendar days, not the time off the job the member takes to care for them.

If you have or had this situation that was denied the time, please contact Victoria Kintzer so that you can be included in their case in the Law Suite that has been filed.

There have been several incidents in which our members have been denied FLMA time trying to cover Pre-admission Testing.

After a review of contract language in all of the areas, there is no need to submit a request for FMLA time to cover Pre-admission tests. There is no need to lose part of the 12 weeks of FMLA time for that period.

Under your contracts, doctor's information is required to be provided to the office indicating the need for Pre-admission testing. At that point, the absence is not considered chargeable and the time off is paid.

If anyone was adversely effected by a denial for FMLA time for any Pre-admission tests, you need to contact your Union Representative to file a grievance.
